That case my civil procedure professor argued before the U.S. Supreme Court last October? He won :)

I should add that Justice Souter wrote the opinion, and that in it he managed to use the word "freakish." Justice Souter has not used the word "freakish" in any opinion since Grubart v. Great Lakes (513 U.S. 527) in 1995.
